    Do Grandparents have rights if the parent are still together?
    Ok here goes. My husband and I are happily married and have been for over 8 years. My mother seems to think that she get visitation and or custody of our 2 boys. But it has been mentally and physically proven she can not take care of them. She weighs 350lbs and is mentally disable. So should she have the right to take me to court to get my boys ( ages 8 and 2 )?

    Anyone can try to get custody if your children are being abused and neglected. If they are well cared for, then you and your husband get to decide about grandparents visits, if you agree and live together.
    Even if your mother can’t care for the children, can’t she see them at your home, or with you present? Maybe if she is not upset about not seeing the children, she wouldnt be making threats about court.

    If she can prove you are an unfit mother, then it is possible the Children Protective Services would place the children in her care, as they prefer family members to foster homes ran by strangers.

    But as far as visitation rights, that varies with each state as each state gets to write its own laws.
